Liability AND Risk Waiver:
I understand and agree that by purchasing a ticket and participating in a NCSHC sponsored event there is the possibility of physical injury. I agree, therefore, to assume all risks of any such injury to myself (or on behalf of my minor child) which might occur during all the NCSHC events, including, but not limited to the spring prom. I exempt, release, and indemnify NCSHC, its venue providers, music providers, and all NCSHC board members from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, or injury to me (or my minor child) or my (my minor child’s) personal property which may arise out of or in connection with participation in any events or activities conducted by NCSHC, whether such loss, damage, or injury results from the negligence, passive or active, of NCSHC, its members, agents, founders, or from some other causes.
I understand that the 2019 Novel Corona virus disease (COVID-19) has been declared a worldwide pandemic by the World Health Organization and is reported to be extremely contagious. The state of medical knowledge is ever-evolving, and the disease is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and in the air. People can also be infected and show no symptoms (asymptomatic) and therefore spread the disease. Evidence has shown the disease can cause serious and potentially life-threatening illness, and even death. The Participant is aware of the highly contagious nature of bacterial and viral diseases, including, without limitation, the COVID-19 disease, and the risk that the Participant may be exposed to or contract the COVID-19 disease or another disease or illness by being on the Premises or engaging in any Activity/Event. The Participant understands and acknowledges, by purchasing a ticket and attending the event, that such exposure or infection from the COVID-19 virus or other illness may result in serious illness, personal injury, permanent disability, death, or personal property damage. The Participant acknowledges that this risk may result from or be compounded by the actions, omissions, or negligence of others, including NCSHC, event venues, music providers, and designated board members of NCSHC. The Participant understands that while NCSHC and others mentioned have implemented preventative measures to reduce the spread of COVID-19 and other illnesses, they cannot guarantee that the Participant will not become infected with COVID-19 or any other illness while on the premises or participating in any event, and that being on the premises or participating in the event may increase the Participant’s risk of contracting COVID-19 or another illness. NOTWITHSTANDING THE RISKS ASSOCIATED WITH COVID-19 AND OTHER ILLNESSES, THE PARTICIPANT ACKNOWLEDGES THAT HE OR SHE IS VOLUNTARILY ENTERING THE PREMISES OR ENGAGING IN ANY ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED. THE PARTICIPANT HEREBY AGREES TO ACCEPT AND ASSUME ALL RISKS OF PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE RELATED TO COVID-19 OR ANY OTHER ILLNESS, ARISING FROM BEING ON THE PREMISES, OR ENGAGING IN ANY EVENT/ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF VENUE PROVIDER, OR BOARD MEMBERS OF NCSHC OR OTHERWISE.
Ticket sales are non-refundable and non-transferable.
